Mr. May started out his professional career as a Civil Engineer and after he obtained his professional engineering licenses in the states of California and Nevada, Mr. May put his professional career on hold while he went back to law school. Mr. May is one of only a handful of attorneys in the United States that has achieved the distinction of dual licensure as both a professional engineer (i.e., in the State of California) and as an attorney licensed to practice law in both Nevada and California. Mr. May's legal practice areas include Administrative Law (i.e., including representing contractors and owners with regard to license dispute and board complaints), Construction Law, Real Estate Law, Construction Defect Litigation, Professional Design Liability, Mechanic's Liens, Bond Claims, Business Collections, Professional Licensing Defense and general civil litigation. During Mr. May's career as an attorney, he has represented all facets of the construction industry, including owners, general contractors, subcontractors, design professionals, material suppliers, equipment suppliers and even manpower companies.

Biography: Mr. May has spent most of his life in Southern Nevada. One of his early notable accomplishments was achieving the distinction as one of four valedictorians in his high school graduating class. Mr. May attended the University of Nevada, Las Vegas ("UNLV") and, while attending, was regularly included on the Dean's Honor list. Mr. May was also recognized by the Department of Civil and Environmental Engineering with a Certificate of Excellence for his academic achievements. In May of 1994, Mr. May obtained his Bachelor of Science degree in Civil Engineering, graduating with the distinction of Magna Cum Laude. Another of Mr. May's notable accomplishments was his selection by the faculty of the College of Civil and Environmental Engineering as the student speaker for the graduation ceremony.

Prior to attending law school, Mr. May worked as a Civil Engineer in Southern Nevada where he obtained his Professional Engineering Licenses for both the States of California and Nevada.

While working as a civil engineer, Mr. May performed a variety of engineering design duties, including the preparation of improvement plans for subdivisions, master planned communities, major street improvements, a major potable water line, and storm drain channels. Mr. May also prepared various technical reports evaluating potable water demand and design criteria, hydraulic design criteria, hydrologic quantity and design criteria, as well as Conditional/Final Letters of Map Revisions to remove land from the 100-year Flood Plain for development.

After practicing civil engineering for several years and achieving the status as a registered Professional Engineer, Mr. May put his engineering career on hold and moved to Iowa with his wife and children to attend law school at the University of Iowa, College of Law. While in law school, Mr. May was a member of the Journal of Corporate Law and participated in the Trial Advocacy Program, the Stephenson Competition, and the University of Iowa Legal Clinic. Mr. May graduated from the University of Iowa, College of Law "with distinction" in May of 2001.

As an attorney, Mr. May has prepared materials for and presented seminars on a variety of legal topics relating to his areas of practice, including seminars on mechanic's lien and bond law, general construction law principles, Nevada State Contractor's board issues and contract law. In addition, Mr. May was a Co-Author of the book entitled: "STATE-BY-STATE GUIDE TO CONSTRUCTION CONTRACTS AND CLAIMS."

Another of Mr. May's most notable accomplishments was his selection as a Bar Examiner for the Nevada State Bar Exams.

Memberships: Mr. May, through his company, is a member of the Construction Financial Management Association (CMFA). He is also a member of the Nevada Bar Association, the Clark County Bar Association, the California Bar Association, the American Bar Association, American Society of Civil Engineers and the Tau Beta Pi Honor Society.

Legal Admissions: Mr. May is admitted to the State Bar of Nevada; the U.S. District Court, District of Nevada; and the State Bar of California. Mr. May is also on inactive status as a member of the Iowa Bar Association.

Summary of Notable Litigation Accomplishments: During Mr. May's legal career, he has represented his clients with the same uncompromising work ethic and vigor that he learned as a youth, growing up in a small town in Southern Nevada. Some of his notable accomplishments include the following:

• Mr. May has assisted multiple contractors in their disputes with the Nevada State Contractors Board, including several matters where Mr. May prevailed against the NSCB on all claims alleged against Mr. May's clients.
• Construction Contract Reviews: Clark County, Nevada, (Performed multiple contract reviews and prepared detailed summaries of issues to be addressed during contract negotiations for a fortune 500 Subcontractor and others, one of which was in excess of $90 Million.)
• Utilities Inc. of Central Nevada vs. Spirit Underground, LLC, et. al., (Clark County, Nevada, District Court Case No. A-11-646674-B) and its sister case of Nye County vs. Utilities Inc. of Central Nevada, et. al., (Nye County, Nevada, District Court Case No. CV34371) where Mr. May used is engineering background to assist him with his case preparation of a multi-party lawsuit, which resulted in his client settling its portion of the two cases for less than 2% of the overall settlement amount.)
• Capriati Construction Corp vs. Lake Havasu City, et. al., (Mohave County Superior Court, Case No. CV201200764) where Mr. May successfully settled his client's portion of the lawsuit for less than 3% of the original amount claimed by the Plaintiff and for approximately 11% of the actual settlement amount paid to Plaintiff in that matter by all parties involved.
• Mr. May and Agiimaa Tsogt recently obtained a judgement in the amount of $35 million for one of their business clients here in Clark County Nevada.
